Terms
These terms cover the use of this website and the CPS portal. The delivery of a CPS programme itself is covered by the separate written agreement between CPS and your facility.

This website and the CPS portal are operated by Care Performance Systems (CPS), an Australian business. By using this website or the portal you agree to these terms. If you do not agree with them, please do not use the site.
The content on this website describes what CPS does in general terms. It is not advice, it is not an offer capable of acceptance, and nothing on it forms a contract. What CPS will actually deliver for a facility, on what schedule and at what price, is set out only in a signed service agreement.
CPS provides workplace movement, ergonomics and training support. Nothing on this website or in the CPS portal is medical advice, a diagnosis or a treatment, and none of it replaces assessment or advice from a qualified health professional. See our disclaimer for the detail.
Portal accounts are issued by CPS to named individuals at facilities that hold a current agreement. Accounts are personal to the individual and must not be shared. You are responsible for keeping your sign-in details secure and for activity carried out under your account. Tell us promptly at info@careperformancesystems.com if you think an account has been compromised, or if someone with an account leaves your organisation.
CPS may suspend or remove an account where it is being misused, where access is no longer appropriate, or where a facility agreement ends.
Do not attempt to access information you have not been given access to, interfere with the operation or security of the site or portal, scrape or bulk-download content, or use the site to send anything unlawful, misleading or harmful. Do not use another person's account or attempt to identify individuals from aggregated reporting.
The CPS name, logo, assessment instruments, training content, exercise library, report formats and the platform itself remain the property of Care Performance Systems. A facility engaging CPS is given the right to use these materials for its own workforce for the term of its agreement. They may not be copied, adapted, resold, or used to build a competing programme.
How CPS handles personal information is set out in our privacy policy, which forms part of these terms. Facilities must not upload or send CPS information about people who have not been told that CPS is involved, and must not send resident or client information to CPS at all.
We aim to keep the site and portal available, but they may be unavailable from time to time for maintenance or for reasons outside our control. We do not guarantee uninterrupted availability, and we may change or withdraw features.
Where we link to another organisation's website, we do so for convenience. We are not responsible for the content of those sites and a link is not an endorsement.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
Subject to that, CPS is not liable for indirect or consequential loss arising from use of this website, and our liability in connection with the website is limited to re-supplying the relevant service or the cost of doing so. Liability in relation to a delivered programme is dealt with in the service agreement for that programme.
These terms are governed by the laws of Australia and the courts of Australia have jurisdiction over any dispute arising from them.
We may update these terms; the date at the top will change when we do, and continued use of the site means you accept the updated terms. Questions about anything here go to info@careperformancesystems.com.
